• PREPARED TRAVEL IS NOT A MEDICAL PROVIDER. The Services do not replace medical advice or emergency care.

• AI-generated translations and audio may contain errors. You are responsible for reviewing and verifying outputs before use.

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and Prepared Travel (“Prepared Travel,” “we,” “us,” or “our”) governing your access to and use of the Prepared Travel website, digital tools, software systems, travel consultation services, AI-generated outputs, physical products, and related offerings (collectively, the “Services”).

By accessing, purchasing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree, you must not use the Services.

2. Eligibility

You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction, to use the Services.

If using the Services on behalf of a minor, you represent that you are the minor’s legal parent or guardian and accept full responsibility for all use and consequences.

3. Nature of the Services

Prepared Travel provides communication tools and travel-related informational services, including but not limited to:

• Structured translated allergy and dietary communication cards

• AI-generated audio files (MP3 outputs)

• Travel consultations and advisory services

• Itinerary suggestions

• AI-assisted travel planning tools

Prepared Travel is not a medical provider and is not a licensed travel agency unless expressly stated in writing.

All Services are informational and advisory only.

4. Medical Disclaimer; No Healthcare Relationship

PREPARED TRAVEL DOES NOT PROVIDE MEDICAL CARE, MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

USE OF THE SERVICES DOES NOT CREATE A PHYSICIAN–PATIENT, PROVIDER–PATIENT, FIDUCIARY, OR OTHER PROFESSIONAL RELATIONSHIP.

The Services are informational communication tools only. They are not intended to diagnose, prevent, treat, cure, or manage any medical condition, including food allergies or dietary sensitivities.

You are solely responsible for consulting qualified healthcare professionals regarding allergy management and medical decisions.

The Services are not a substitute for carrying emergency medication or seeking immediate medical attention. In a medical emergency, contact local emergency services immediately.

5. Translation Framework and Artificial Intelligence

5.1 Structured Translation System

Text-based allergy cards are generated from structured, parameterized translation frameworks.

Despite validation efforts, language is contextual and variable. Translation errors, omissions, dialect differences, and ambiguities may occur.

Prepared Travel makes no warranty regarding translation accuracy or completeness.

5.2 AI-Generated Audio

Audio outputs are generated using third-party AI text-to-speech services, including but not limited to OpenAI APIs.

Audio may contain pronunciation errors, dialect differences, improper emphasis, or ambiguity.

Audio files are provided strictly on an “AS IS” basis.

Prepared Travel disclaims liability arising from reliance on audio outputs.

6. Assumption of Risk

You acknowledge that:

• Translations may contain inaccuracies or ambiguities

• Audio output may be mispronounced or misunderstood

• Food preparation standards vary by location

• Third parties may act negligently or unpredictably

• Travel conditions may change without notice

• You are responsible for reviewing and verifying outputs before use, including consulting a fluent speaker where feasible if you have any doubt

You voluntarily assume all risks associated with your use of and reliance upon the Services.

7. Travel Advice and AI Itineraries

Travel recommendations and AI-generated itineraries are advisory only and not guarantees.

Prepared Travel does not control airlines, hotels, restaurants, or other travel providers.

Travel inherently involves risk, including delays, cancellations, illness, cross-contact, and third-party negligence.

All travel decisions remain solely your responsibility.

8. Orders, Fulfillment, and Delivery

Physical products are custom-produced.

Production and shipping timelines are estimates only.

Digital products are deemed delivered when electronically accessible.

Prepared Travel is not responsible for delays beyond reasonable control.

9. Payments

Payments are processed through third-party providers (e.g., Stripe).

Prepared Travel does not store full credit card numbers.

We may retain transaction identifiers and tokenized payment references for fraud prevention, analytics, for purposes including facilitating future transactions, record keeping, and customer support.

By submitting payment information, you authorize the applicable processor to charge your payment method.

10. Refund Policy; Custom Orders

ALL SALES ARE FINAL.

Because Services involve customized digital outputs, AI-generated content, and made-to-order printed materials, purchases are non-refundable once processing begins.

Prepared Travel is not responsible for dissatisfaction, user error, travel disruptions, or changes in plans.

If a physical product is materially defective due solely to manufacturing error, we may provide a replacement at our discretion.

11. Accounts and Privacy

Prepared Travel may create user profiles for order management, personalization, analytics, and fraud prevention.

Your use of the Services is also governed by our Privacy Policy, which describes data practices and any rights available under laws such as the CCPA, CPRA, or GDPR where applicable.

12. Intellectual Property

All intellectual property associated with the Services is owned exclusively by Prepared Travel or its licensors.

You receive a limited, non-transferable license for personal use only.

Reverse engineering, redistribution, resale, or competitive use is prohibited.

13. No Third-Party Beneficiaries

These Terms are solely between you and Prepared Travel. No third party has rights under these Terms.

14. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREPARED TRAVEL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

15. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

PREPARED TRAVEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION ALLERGIC REACTIONS, MEDICAL EVENTS, PERSONAL INJURY, TRAVEL DISRUPTIONS, LOST PROFITS, OR EMOTIONAL DISTRESS.

TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE.

16. Indemnification

You agree to indemnify, defend, and hold harmless Prepared Travel and its owners, officers, employees, contractors, affiliates, licensors, and service providers from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

• Your misuse of the Services;

• Your violation of these Terms;

• Your independent travel, food, or medical decisions;

• Any allergic reaction, injury, or medical event arising from your actions;

• Any chargeback or fraudulent transaction initiated in connection with your purchase;

• Any third-party claim arising from your conduct in connection with your use of the Services.

Prepared Travel may assume exclusive defense of any matter subject to indemnification, and you agree to cooperate.

17. Dispute Resolution; Binding Arbitration; Class Action Waiver

Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.

The arbitrator shall have exclusive authority to resolve any dispute regarding the interpretation or enforceability of this arbitration agreement.

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR TO A JURY TRIAL.

Arbitration shall take place in Illinois. Either party may bring qualifying claims in small claims court.

You may opt out of arbitration within thirty (30) days of first accepting these Terms by written notice.

18. Governing Law

These Terms are governed by the laws of the State of Illinois.

19. Severability

If any provision is unenforceable, the remaining provisions remain in effect.

20. Survival

Medical Disclaimer, Assumption of Risk, Refund Policy, Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Arbitration provisions survive termination.

21. Force Majeure

Prepared Travel is not liable for delays or failures beyond reasonable control.

22. Modifications

Prepared Travel may update these Terms at any time. Continued use constitutes acceptance.
